California Workplace Investigations

Workplace Investigations That Help Organizations Find the Facts

Workplace complaints can affect employees, leadership, operations, morale, and an organization’s reputation. When the facts are disputed or the matter is especially sensitive, the organization needs a careful process led by someone capable of listening objectively, identifying relevant evidence, and documenting the work clearly.

The Investigative Group provides workplace and employee-misconduct investigations throughout California. Headquartered in Northern California, TIG combines decades of experience across investigations, law enforcement, government, human resources, and county-level management with discreet, responsive, highly personalized service.

Matters TIG Can Help Investigate

Every engagement begins with a discussion of the allegations, the lawful purpose of the investigation, the appropriate scope, and TIG’s role. Depending on the circumstances and TIG’s authorized scope, workplace matters may involve allegations or concerns such as:

  • Harassment or discrimination
  • Retaliation
  • Employee misconduct
  • Policy violations
  • Fraud, theft, or misuse of organizational resources
  • Conflicts of interest
  • Workplace threats or concerning conduct
  • Falsification of records
  • Abuse of authority
  • Vendor or procurement concerns
  • Time, attendance, or leave-related misconduct
  • Inappropriate electronic or social-media activity
  • Other disputed workplace events requiring neutral fact gathering

TIG does not predetermine whether an allegation is true. The purpose of an investigation is to gather and assess information within the agreed scope.

Why Organizations Use an Outside Investigator

An outside investigator may be helpful when internal personnel have a conflict, when the allegations involve leadership or HR, when an organization lacks sufficient internal capacity, or when the matter requires specialized interviewing and evidence-gathering experience.

An external investigator can also provide separation between the fact-finding process and the organization’s eventual employment or legal decisions. TIG gathers and reports facts within its assigned role; the client and its counsel or designated decision-makers determine what action, if any, should follow.

TIG’s Approach

1. Initial assessment

TIG learns what was reported, identifies the people and issues potentially involved, discusses timing and available records, and clarifies who will direct the engagement.

2. Defined scope

A useful investigation begins with clear questions. TIG works with the authorized client representative—and, where applicable, counsel—to define the allegations, relevant time period, potential witnesses, anticipated evidence, reporting expectations, and communication protocol.

3. Evidence preservation and review

Potentially relevant materials may include policies, complaints, correspondence, messages, schedules, personnel records, photographs, video, access records, or other authorized information. What should be preserved or reviewed depends on the circumstances. Legal counsel should guide preservation decisions where litigation, privacy, privilege, or regulatory concerns may exist.

4. Interviews

TIG prepares for and conducts interviews designed to obtain detailed information, identify corroborating or conflicting evidence, and give relevant participants an appropriate opportunity to provide their account.

5. Follow-up

New evidence or testimony may require additional interviews, document requests, or clarification. TIG follows appropriate leads within the authorized scope rather than treating interviews as an isolated checklist.

6. Documentation and reporting

The final work product depends on the engagement. TIG can provide organized documentation and a clear report addressing the assigned issues, investigative steps, relevant evidence, and findings authorized by the agreed scope.

Experience Across Investigations, HR, Government, and Management

Workplace matters sit at the intersection of people, policy, evidence, and organizational decision-making. TIG’s background across investigations, law enforcement, government, human resources, and county-level management provides a multidisciplinary perspective that is particularly valuable in sensitive or complex matters.

That experience does not replace neutrality. It helps TIG recognize important questions, understand organizational environments, communicate with different stakeholders, and approach each matter with both rigor and compassion.

Confidentiality and Respect

Workplace investigations often involve private and sensitive information. TIG handles information discreetly and shares it according to the engagement’s authorized communication structure. Absolute confidentiality cannot always be promised because an effective investigation may require disclosure of certain information to witnesses, decision-makers, counsel, or others. TIG instead works to protect privacy to the extent consistent with the investigation and applicable requirements.

Serving Organizations Throughout California

TIG provides workplace-investigation services throughout California, with especially deep familiarity and coverage in Sacramento and Northern California, including Folsom, Roseville, El Dorado Hills, Placer County, and El Dorado County. Availability for in-person work, travel, remote interviews, or coordinated services depends on the location and needs of the engagement.

Frequently Asked Questions

Does TIG represent the employer or an employee?

TIG’s client and role are identified in the engagement agreement. In a workplace investigation, TIG serves as a fact finder within the authorized scope and does not act as legal counsel for interview participants.

Can TIG guarantee a particular finding?

No. A professional investigation cannot ethically promise that evidence will support a predetermined conclusion. TIG can promise diligence, impartial fact gathering, careful documentation, and candid communication.

Can an investigation be conducted remotely?

Some interviews and evidence review can be conducted remotely. In-person work may be preferable when credibility, physical evidence, location access, security, or other circumstances make it important. TIG recommends an approach based on the matter.

Does TIG provide legal advice?

No. TIG provides investigative services. Clients should consult qualified employment counsel regarding legal duties, privilege, employee rights, preservation obligations, and employment decisions.

How quickly can TIG begin?

Timing depends on availability, the number of participants, the volume of evidence, travel, and the complexity of the issues. Contact TIG promptly when a matter arises so that scope, timing, and preservation needs can be assessed.
