Flock Cameras in California: Safety Tool or Privacy Threat?

Automated license plate readers have become common along California roads, near shopping centers, at neighborhood entrances, and inside public parking areas. Many drivers pass these cameras every day without recognizing them or understanding what information they collect.

Flock Safety operates one of the largest automated license plate reader networks in the United States. Its cameras provide law enforcement agencies, businesses, and participating communities with searchable information about vehicles traveling through public areas.

Supporters view these systems as valuable tools for locating stolen vehicles, identifying cars associated with crimes, finding missing persons, and developing investigative leads. Critics raise concerns about privacy, oversight, data sharing, retention periods, accuracy, and the possibility of misuse.

The debate presents an important question. How should communities balance legitimate public safety needs against the privacy interests of people whose movements are recorded despite no suspected criminal activity?

Flock Is a Newer Brand, but ALPR Technology Is Not New

Much of the current debate treats automated license plate readers as a recent invention. The technology has a much longer history.

License plate recognition systems have been used in Europe since the 1980s and became available to American law enforcement agencies during the 1990s. Early systems were expensive, limited in coverage, and often mounted on police vehicles or positioned at specific locations. Improvements in digital imaging, optical character recognition, cloud storage, wireless communication, and searchable databases expanded their reach and usefulness.

Flock did not invent the concept of reading license plates automatically. Its importance comes from making fixed ALPR cameras easier to deploy and connecting large numbers of observations through a searchable platform. The current controversy therefore involves more than the camera itself. It involves the size of the network, the number of recorded observations, the ease of searching across jurisdictions, and the rules governing access.

The U.S. Department of Justice has discussed license plate recognition technology in law-enforcement research for many years. One federal research summary noted the technology had been available to American law enforcement since the 1990s. This history helps place the current debate in context. The investigative method is established, while the scale, connectivity, and storage capabilities have changed significantly.

What Is a Flock Camera?

A Flock camera is a type of automated license plate reader, commonly called an ALPR. These cameras are usually positioned along roads, at intersections, near entrances, or in other areas where vehicles pass through a defined location.

Unlike a traditional traffic camera, an ALPR system focuses primarily on vehicle information. When a vehicle passes, the system creates a record associated with the observation.

Depending on the equipment and system configuration, the record often includes:

  • The license plate number
  • An image of the vehicle
  • The date and time of the observation
  • The camera location
  • The vehicle’s make, model, color, and body style
  • Visible characteristics such as a roof rack, bumper sticker, damage, or missing hubcap

The system turns each observation into searchable vehicle data. An authorized user searching for a specific vehicle might locate sightings based on a full license plate, partial plate, vehicle description, location, or period of time.

Flock states its license plate reader product does not use facial recognition or identify the driver. The cameras focus on vehicles rather than personal identities. Still, repeated vehicle sightings at different locations have the potential to reveal information about a person’s travel patterns.

How Law Enforcement Uses ALPR Information

Automated license plate readers provide investigators with a faster method of reviewing large numbers of vehicle observations.

An agency might enter the license plate of a stolen vehicle into a notification list. When a participating camera detects the plate, the system sends an alert to authorized personnel. Officers then assess the information and determine whether further action is appropriate.

ALPR information also supports investigations involving:

  • Stolen vehicles
  • Missing or endangered persons
  • Amber Alerts
  • Hit-and-run collisions
  • Robberies and burglaries
  • Homicides
  • Vehicle theft rings
  • Organized retail theft
  • Vehicles connected with outstanding warrants

The information rarely proves an entire case by itself. It usually serves as one investigative lead among several.

A camera observation might show a vehicle near a relevant location during a specific period. Investigators still need to confirm whether the plate was read correctly, whether the vehicle description matches, who had possession of the vehicle, and how the observation relates to other evidence.

The Difference Between an Investigative Lead and Proof

Technology has increased the speed of modern investigations, but speed does not replace careful analysis.

An ALPR record establishes an observation involving a vehicle. It does not automatically establish who was driving, why the vehicle was present, where it traveled afterward, or whether its presence was connected with criminal activity.

License plates also get stolen, altered, duplicated, or incorrectly entered into databases. Vehicles get borrowed, rented, sold, or shared among family members. A reliable investigation examines these possibilities before reaching a conclusion.

Attorneys reviewing ALPR evidence should consider several questions:

  • Was the license plate read accurately?
  • Does the captured vehicle match the suspected vehicle?
  • Were the date, time, and camera location verified?
  • Who owned or possessed the vehicle at the time?
  • What retention and preservation procedures applied?
  • Who accessed or searched the information?
  • Was the search connected with an authorized investigative purpose?
  • Does independent evidence support the ALPR observation?

The answers help determine the proper weight of the evidence.

How Long Is Flock Information Stored?

Retention periods vary by agency, contract, product, and local policy.

In 2026, Flock announced a seven-day default retention period for its license plate reader data, subject to different requirements established by customer policies, contracts, or applicable law. The company also introduced an evidence-preservation process for information connected with active investigations.

Some agencies have used longer retention periods. For this reason, no one should assume every Flock system follows the same deletion schedule.

The retention period matters for investigators and attorneys. Relevant information might disappear before a party realizes its importance. When a case involves a vehicle’s location or movement, identifying possible ALPR sources and sending appropriate preservation requests early in the investigation deserves prompt attention.

Why Are Some Communities Trying to Ban Flock Cameras?

Public concern over Flock cameras has intensified across the country. Residents have attended city council meetings, circulated petitions, demanded moratoriums, and called for local governments to terminate their contracts with Flock Safety.

Several California cities have suspended, discontinued, or reconsidered their programs. Mountain View turned off its Flock cameras after city officials reported losing confidence in the vendor’s compliance with local data-access and transparency requirements. Pasadena officials have also discussed terminating Flock contracts. Other communities have continued using the systems while adopting stronger restrictions and oversight.

California lawmakers are considering additional statewide rules governing automated license plate reader information. Senate Bill 1013 would establish limits involving retention, access, training, search documentation, and outside data sharing. The proposal reflects a broader concern about whether existing policies provide enough protection when large networks of vehicle observations become searchable across multiple jurisdictions.

This movement is sometimes described as an effort to ban Flock cameras. In practice, the proposals differ. Some advocates want complete removal. Others support a temporary pause, shorter retention periods, tighter search requirements, restricted data sharing, or independent audits.

Understanding the debate requires separating legitimate concerns from common misconceptions.

The Arguments Against Flock Cameras

Opponents often begin with the scale of the collection.

A person driving on a public road has no reasonable expectation of remaining unseen. Police officers, security cameras, witnesses, and other drivers might observe the vehicle. Flock cameras change the nature of this observation by recording large volumes of vehicle information and placing it into a searchable database.

The concern involves aggregation. One observation shows a vehicle at one place and time. A network of observations has the potential to reveal patterns involving where someone works, worships, receives medical care, attends political events, visits family, or spends private time.

Critics also raise concerns about data sharing. Information collected by one community might become available to another agency through a regional or national network. When sharing rules are broad or poorly monitored, an agency might access information for a purpose prohibited by the community where it was collected.

California has already experienced disputes involving searches conducted for federal or out-of-state agencies. These incidents have increased public concern about immigration enforcement, reproductive healthcare investigations, political activity, and other matters subject to different laws across state lines.

Misuse by authorized users presents another concern. Any searchable government database creates a risk of employees accessing information for personal, political, or otherwise unauthorized reasons. Audit logs help identify misuse after it occurs, but they do not eliminate the initial intrusion.

Accuracy also matters. A license plate might be misread because of lighting, weather, camera placement, plate damage, or image quality. Officers who treat an automated alert as proven fact risk stopping the wrong vehicle or detaining an innocent person.

Opponents therefore argue the issue extends beyond whether the cameras photograph public roads. They question whether communities should maintain a searchable record of routine travel when most recorded vehicles have no connection with criminal activity.

The Arguments Supporting Flock Cameras

Law enforcement agencies and supporters point to the technology’s documented investigative value.

ALPR alerts assist officers in locating stolen vehicles, missing children, endangered adults, wanted suspects, and vehicles associated with violent crimes. Investigators also use historical observations to identify leads, confirm timelines, locate additional evidence, and narrow searches during time-sensitive cases.

Traditional investigative methods often require officers to review hours of surveillance video, contact numerous businesses, or rely on witnesses who remember only part of a license plate or vehicle description. An ALPR search provides investigators with a faster starting point.

Supporters also emphasize the limited nature of the information collected by the license plate reader product. According to Flock, its ALPR cameras record vehicle information rather than facial recognition data. A camera observation does not automatically identify the driver, access the contents of the vehicle, or prove criminal conduct.

Everyday travel already leaves information in many places. Toll systems, parking garages, access gates, traffic cameras, commercial surveillance systems, mobile devices, and financial transactions all create records connected with time and location. Supporters view ALPR information as another investigative resource, provided agencies use it for defined public-safety purposes.

They also argue a complete ban removes a useful tool because of problems better addressed through policy, supervision, auditing, and enforcement. From this perspective, the appropriate response to misuse is accountability and stronger safeguards rather than eliminating the technology.

Are the Public’s Fears Irrational?

Some fears are based on incorrect assumptions.

Flock’s license plate reader product does not use facial recognition, according to the company. It does not automatically identify every driver. A single camera does not continuously follow a vehicle from one location to another. Each camera records a separate observation when a vehicle passes through its field of view.

Those distinctions matter.

Still, concerns about access, sharing, retention, accuracy, and misuse are grounded in real events. Cities have identified unauthorized or improper searches. Agencies have reported information-sharing problems. Inaccurate alerts have occurred. Public officials have questioned whether existing vendor controls and agency policies provide adequate protection.

The public debate sometimes combines verified risks with exaggerated claims. This makes the technology sound either completely harmless or inherently dangerous. Neither description provides a complete picture.

Flock cameras are investigative tools. Their impact depends on how agencies deploy them, who receives access, which searches are permitted, how long information remains available, and whether meaningful oversight exists.

Would a Complete Ban Make Sense?

A complete ban would eliminate the privacy risks associated with a government-operated ALPR network. It would also eliminate a resource used to recover stolen vehicles, locate missing persons, identify dangerous suspects, and develop leads in serious criminal investigations.

A more measured approach focuses on the specific risks. Reasonable safeguards include:

  • Short and clearly defined retention periods
  • A documented investigative purpose for every search
  • Case numbers or incident numbers connected with searches
  • Restrictions on federal and out-of-state access
  • Supervisory review of sensitive searches
  • Automatic alerts for suspicious activity
  • Regular audits by someone outside the immediate user group
  • Publicly available usage and privacy policies
  • Independent review of accuracy and system performance
  • Immediate suspension of users suspected of misuse
  • Meaningful discipline or prosecution when misconduct occurs
  • Public reporting about searches, sharing, policy violations, and corrective action

These controls preserve the legitimate investigative value of the technology while reducing the opportunity for misuse.

The central question is not whether technology should assist investigations. The question is whether its use remains limited, documented, transparent, and accountable.

Public safety and privacy are both legitimate interests. Communities deserve an honest discussion about the benefits and risks rather than decisions driven entirely by fear, vendor assurances, or political pressure.

California’s ALPR Privacy Requirements

California regulates automated license plate reader systems through Civil Code sections 1798.90.5 through 1798.90.55.

The law requires ALPR operators and users to maintain reasonable security procedures and practices. Public agencies operating these systems must adopt a usage and privacy policy addressing authorized users, permitted purposes, data security, oversight, retention, and information sharing.

California law also limits the sale and sharing of ALPR information by public agencies. Public agencies generally must restrict access to authorized purposes and permitted public-agency recipients.

The existence of a law or written policy does not end the discussion. Effective oversight requires agencies to enforce their policies, review access logs, investigate questionable searches, provide appropriate training, and respond when misuse occurs.

Could Flock Information Become Evidence?

ALPR information has potential relevance in criminal, civil, family, insurance, and workplace-related matters.

Examples include:

  • Confirming or challenging a reported timeline
  • Identifying a vehicle near an incident location
  • Locating a vehicle connected with a collision
  • Comparing a witness statement with recorded vehicle activity
  • Evaluating an alibi
  • Tracing the movement of stolen property
  • Identifying additional locations for video or witness searches
  • Supporting or disputing allegations involving travel or presence

The legal admissibility and evidentiary value depend on the facts, how the information was obtained, its reliability, and the purpose for which it is offered.

An investigator should treat the record as part of a larger evidence set. The strongest analysis compares ALPR information with surveillance video, photographs, phone records, witness interviews, transaction records, dispatch information, and other independent sources.

What Should the Public Know?

Most vehicles photographed by an ALPR system have no connection with criminal activity. The system collects observations broadly and searches them later when an authorized user identifies a reason to look for a particular vehicle.

Residents interested in local practices should review the responsible agency’s published ALPR policy. Useful information includes camera ownership, retention periods, authorized uses, data-sharing relationships, audit procedures, and the process for reporting suspected misuse.

Public discussion should also recognize both sides of the issue. ALPR systems have helped investigators locate dangerous suspects, recover stolen vehicles, and find missing people. The same technology creates legitimate concerns when access rules are unclear, sharing becomes too broad, or oversight fails.

A responsible system needs more than effective equipment. It needs defined purposes, limited access, documented searches, regular audits, reasonable retention periods, and meaningful consequences for misuse.

The technology was never a substitute for solid police work. An alert still required verification. Investigators still needed to determine who possessed the vehicle, whether the observation related to the incident, and whether other evidence supported the lead. Used properly, ALPR information was an effective investigative resource. Used carelessly or without appropriate oversight, the same information created risks.

My experience leads me to support responsible use rather than a complete ban. Agencies should retain access to effective investigative tools, but the public also deserves clear policies, limited retention, documented searches, meaningful audits, and consequences for misuse.

Flock cameras and other automated license plate readers have changed how vehicle related information enters an investigation. They provide speed, volume, and search capabilities unavailable through traditional observation alone.

Their results still require human judgment.

A camera record should be verified, placed in context, compared with independent evidence, and evaluated for alternative explanations. Attorneys and investigators should understand both the value and the limitations of the technology before relying on it.

The most reliable investigation does not begin with a desired conclusion. It begins with the available evidence, tests its accuracy, identifies what remains unknown, and follows the facts wherever they lead.
